The Status of Intellectual Property Rights in Kosovo

According to the information just received from the Kosovo Trade Mark Office, it will be possible to file Revalidation Applications and/or new Applications for Trade Marks, Patents and Designs as from 19 November 2007, being the date from which the Kosovo Intellectual Property Office will start working.

The rights eligible for revalidations are all the rights registered in Serbia/Yugoslavia before 19 November 2007. All the rights applied for, but not registered before 19 November 2007 in Serbia, will be eligible for Re-Applications, maintaining the original application date.

The documents needed for Re-validation of former Serbian/Yugoslav rights are as follows:

  • Proof of valid right in Serbia/Yugoslavia (which will be obtained by our office in Belgrade)
  • Simply signed power of attorney (form of which is attached herewith)

According to the Kosovo IP Law, the time limit for effecting the revalidations will be 12 Months starting from 19 November 2007 (meaning until 18 November 2008, inclusive).

All the former Serbian/Yugoslav rights which are not revalidated during this period will cease to be valid in Kosovo.

Bearing in mind the above, we kindly ask you to send us all the Trade Marks/Patents/Designs with corresponding Serbian Registration/Application numbers which you will be interested in revalidating, so that we can obtain the necessary documents and start the re-validation process immediately.

Alternatively, you may wish to proceed with any new Applications, for which we will need the usual application details as well as the power of attorney.

Please note that the ways of dealing with International Registrations designating Serbia is still unknown.

Also, as from 19 November 2007 Kosovo should be taken as a separate IP Jurisdiction, and all the new filings will have to be done separately from the Serbian ones.
